Job title: Legal Counsel - Market Access
About the Role BioMarin seeks a legal leader to provide expert advice to the business on a broad range of activities in a highly regulated environment, with primary responsibility for supporting BioMarin's Market Access function including Pricing, Access, Value, and Evidence for Managed Markets, Pricing, Government Pricing, and Patient Support.
What You'll Do
- Provide legal advice and counsel on statutory and regulatory obligations under Medicaid, Medicare, 340B, and Veterans Health Care Act, as well as market access, reimbursement, and government pricing issues.
- Advise on government pricing policies, price reporting compliance, and related documents; monitor CMS rules and prepare comments on proposed rules and guidance.
- Review and negotiate a broad range of commercial contracts with customers including payers, PBMs, GPOs, specialty pharmacies/distributors, IDNs, health systems, patient support vendors; draft and negotiate rebates, value-based agreements, data licensing, and other market access contracts.
- Ensure compliance with Anti-kickback Statute and other US healthcare laws; collaborate with Legal & Compliance; participate in Medical Legal Review; advise on product labeling, promotional claims, and communications regarding clinical data.
- Contribute to Legal & Compliance Department projects and share knowledge; participate in committees and group discussions.
- Stay abreast of evolving healthcare legislation and enforcement landscape.
What We're Looking For
- JD from an ABA-accredited law school; member of a state bar.
- Minimum of 8 years post-JD experience advising on legal matters in a life sciences space (law firm, in-house, or both); government price reporting experience.
- Familiarity with HEOR, value communications, and market access promotional considerations (preferred).
- Strong ability to provide practical, business-oriented legal advice in a highly regulated environment balancing legal, regulatory, reputational, and commercial considerations.
- Experience advising on statutes, regulations, and guidance documents applicable to market access activities (Medicaid, 340B, Veterans Administration, anti-kickback statutes, price transparency laws, OIG guidance, False Claims Act, PhRMA Code).
- Significant experience advising on pharmaceutical contracting with customers including payers, PBMs, GPOs, distributors, IDNs, health systems, and patient support.
Nice to Have
- Familiarity with HEOR and health economics outputs and their use in market access communications (if not already listed).
